A landlord must inform a tenant when public services are shared and provide information on how these costs are calculated for community services. (765 ILCS 740) Lead Based Paint – Any apartment built before 1978 must have this endorsement added to each agreement to inform the tenant of this danger. A lessor is required to return a tenant`s deposit within thirty (30) and forty-five (45) days after the end of the tenancy agreement and to provide a broken list of costs if a surety amount is withheld. (765 ILCS 710/1) Radon (420 ILCS 46) – The owner is not required to test radon. Although if the owner discovers that radon exists on the site, they must pass the information on to the tenant. This is not allowed for apartments on the third (3rd) floor or more in a building. Standard Residential Lease (Outside Chicago) – fixed life, usually 12 (12) months to write for each unit of dwelling outside Chicago. Concession (765 ILCS 730) – Any type of lease must be mentioned in the lease. If you enter the page, the header with the words “Granted Concession” must be in at least half an inch high on the document.
If there is a concession, it is considered a misdemeanor in the state of Illinois. Federal law imposes uniform requirements for all 50 states for certain rental/rental contract information. For example, all rental/rental contracts should include: Sublease Contract – Allows a tenant to re-rent their room with the landlord`s consent. Tenants cannot allow the subtenant to stay longer than his or her main tenancy agreement. Return (765 ILCS 710) – The landlord has 30 days to release the deposit to the tenant. If there are withdrawals on the deposit, the landlord must list the deductions and send them to the tenant within 30 days and the balance of the deposit within 15 days (45 days in total). While radon tests do not need to be performed by owners, the hazardous conditions of the lease must be disclosed if tests indicate that dangerous radon values are present in a rental unit in the basement, first or second floor. Disclosure of radon risk is not necessary in cases where sanitation is completed to achieve safe radon levels, or where radon levels are safe. The Illinois Standard Residential Lease Agreement is a contract that structures a rental situation in which one or more tenants live in a property owned or managed by an owner or managed by a landlord, for regular payments. The degree of detail that can be included in the tenancy agreement is the landlord`s responsibility, although each agreement contains (at a minimum) information on the amount of rent, service benefits, bonds, guests, duration and signatures of the party.
